1. Who we are

This online store, vital-casa ("we", "us", "our"), is operated by the trader identified in our Legal Notice, which forms part of, and is incorporated by reference into, these Terms.

By placing an order through this website, you agree to these Terms of Service, along with our Privacy Policy, Shipping Policy, and Refund Policy, each of which forms part of, and is incorporated by reference into, these Terms.

2. Scope

These Terms govern all purchases made through vital-casa. They apply to consumers located in Portugal and, where applicable, other European Union member states.

3. Products

We sell SolarVenti solar air heating units and related accessories. Product descriptions, dimensions, and coverage estimates (e.g., "up to 25 m²") are provided in good faith based on manufacturer specifications; actual performance may vary depending on installation conditions.

4. Orders and contract formation

Placing an order constitutes an offer to purchase. A contract is formed once we confirm your order (by email or order confirmation). We reserve the right to decline or cancel an order — for example, in cases of pricing errors or stock unavailability — in which case you will be notified and any payment refunded in full.

5. Prices and payment

All prices are displayed in EUR and include applicable VAT unless stated otherwise. Payment is processed at checkout through the payment methods offered on the site. Delivery costs are shown separately and confirmed before you complete your purchase — see our Shipping Policy for current rates.

6. Delivery

Delivery terms, timelines, and costs are set out in our Shipping Policy, which forms part of these Terms. Given the size of our products, delivery is currently carried out personally by us within our service area.

7. Your right to cancel (14-day withdrawal right)

If you are a consumer, you have a statutory right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, under Decreto-Lei n.º 24/2014. 8. Damages, defects, and legal warranty

If your item arrives damaged, defective, or does not match your order, you are covered by the statutory conformity warranty (3 years, under Decreto-Lei n.º 84/2021), free of charge. This is separate from, and in addition to, the withdrawal right above. Full details are set out in our Refund Policy.

9. Your account and information

If you create an account or provide personal information when ordering, it will be handled in accordance with our Privacy Policy.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of our products or this website. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under Portuguese or EU consumer protection law, including liability for defective products or personal injury caused by negligence.

The competent alternative dispute resolution (ADR) entity for consumer disputes is the Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve (CIMAAL) — Avª. 5 de Outubro, nº 55, R/C Dtº, 8000-075 Faro, Portugal, tel. +351 289 823 135, consumoalgarve.pt — which has territorial jurisdiction over the Faro district, including Monchique.

12. Governing law and jurisdiction

These Terms are governed by Portuguese law. Any disputes not resolved through the channels above are subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer-protection rules of your country of residence if you are an EU consumer located elsewhere.

13. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
